Welcome to Avocado Allowance (the "App"), operated by Kevin Taniguchi ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our App and the services, features, content, or applications offered by us (collectively, the "Services").
Please read these Terms carefully before using the App. By downloading, accessing, or using the App, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at https://www.privacypolicies.com/live/54dc76ed-1220-4b7e-bcf0-edccabe3bc50), which is incorporated herein by reference. If you do not agree to these Terms, you may not use the App.
Avocado Allowance is a mobile application designed to help users plan, organize, track, and manage personal finances, allowances, and savings goals. Features include budget creation, allowance and chore tracking, expense logging, savings goal management, and AI-powered assistance features.
Access to certain features of the App, such as iCloud/CloudKit synchronization, requires an active Apple ID and is subject to Apple's terms and conditions for iCloud services. You are responsible for maintaining the confidentiality of your Apple ID and for all activities that occur under your account.
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on iOS devices that you own or control, strictly in accordance with these Terms.
User Input: To use AI Features, you may provide text or voice input. This input will be transmitted to the third-party AI service provider for processing to generate a response. Your use of these AI Features is subject to our Privacy Policy regarding data handling.
Disclaimer for AI Output: AI-generated content, suggestions, budgets, or any other output from AI Features are provided for informational and organizational purposes only and do not constitute financial, investment, legal, or tax advice. We make no representations or warranties regarding the accuracy, completeness, or suitability of any AI-generated output. You are solely responsible for reviewing, verifying, and evaluating the AI output and consulting with a qualified professional before making any financial decisions. We are not liable for any errors in AI-generated content or for any decisions or actions you take based on such content.
Fair Use of AI Features: You agree to use the AI Features in a fair and reasonable manner, consistent with personal finance management. We reserve the right to monitor usage and, at our sole discretion, suspend or terminate your access to the AI Features if we deem your use to be abusive, excessive, or in violation of these Terms.
You are solely responsible for all financial data, transaction information, text, notes, and other content ("User Content") that you create, upload, or store using the App. You retain all ownership rights to your User Content.
The Cloud Sync & Backup feature utilizes Apple's iCloud/CloudKit services to synchronize your data across your enabled devices. This service is dependent on your iCloud account functioning correctly. We are not responsible for data loss or synchronization errors that may occur due to issues with iCloud/CloudKit services, your internet connection, or your device.
You agree not to use the App to violate any law, infringe on intellectual property rights, transmit malicious code, attempt to reverse engineer the App, or engage in any conduct that harms us or other users.
The App and its original content (excluding your User Content), features, and functionality are and will remain the exclusive property of Kevin Taniguchi and its licensors.
We may terminate or suspend your access to the App and Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED, BE SECURE, OR THAT THE RESULTS OF USING THE APP WILL MEET YOUR REQUIREMENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Kevin Taniguchi BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT, INCLUDING AI-GENERATED CONTENT. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO FIFTY U.S. DOLLARS ($50.00 USD).
You agree to defend, indemnify, and hold harmless Kevin Taniguchi from any and all claims, damages, and expenses resulting from your use of the App or a breach of these Terms.
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States. Any dispute arising from these Terms shall be settled by binding arbitration in Philadelphia, Pennsylvania.
We reserve the right to modify these Terms at any time. We will provide reasonable notice of material changes. By continuing to use the App after revisions become effective, you agree to be bound by the revised terms.
